You get fined.
Possible even shut down for 10 hours.

To avoid that, use loose leaf and let them see only the current 8 days.

Wake up call for CA Expert DOT Men...... Quit ignoring the whole law would ya?

395.11 Exception III gets ignored, therefore are you thieves? Because you know it's in there!!!

(3) Exception. A driver failing only to
have possession of a record of duty status
current on the day of examination
and the prior day, but has completed
records of duty status up to that time
(previous 6 days), will be given the opportunity
to make the duty status
record current.

So what part of this don't you understand? I have heard Cops telling their new guys to ignore that, like it isn't in there, but THERE IT IS!!!
Explain that would ya?

Can I be given a penalty for not going back in my logbook if employer asks me to do this? Dot audit due in tomorrow. They want me to BACK DATE my log book. I didn't drive during the period they want me to backdate.

IANAL but I think you could be find for an out-of-date loge, which is
supposed top reflect your status correctly, whether you drive or not.

(The first full day of no driving can show the range of dates you were
idle.)

What are the fines for log book violations, are they the same nationwide or do
they vary by state? Is there a difference in fines for not having a log book at
all and not being up to date with the log book? When pulled over and not up to
date, do they allow the driver a certain amount of time to update his log book
before a ticket is issued? Does it make a difference if the log book page for
that date is signed by the driver, even if the log for that day is not up to
date?
Who gets the ticket and or fin .when there is no E logs
in truck yet

I am not a CDL driver. While in Lee’s Summit misouri unloading trees, a thunderstorm blew up and scattered my invoice to customer and, unbeknownst to me my log sheet. Also picked up a cancer dying friend that was visiting his sister in Lee’s Summit, car had broken down and he was to ride w/me to LaMarr, Mo....( right on my way back to tulsa. Weigh station cited me for no log and unauthorized passenger..... anyone know the severity of this? I was driving under 26,000 truck.
Help? I drive long distance very rarely!
Thanks for any help!
